HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42938 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking a direction to respondents Nos.2 and 3 not to arrest them.

Heard and perused the material available on record. 3.

It is the case of the petitioners that the 4th respondent, who is the wife of the 1st petitioner, is threatening to file false cases against them due to matrimonial disputes and therefore, they are apprehending arrest by the official respondents.

Learned Assistant Government Pleader submitted that no crime was registered against the petitioners.

Considering the facts and circumstances of the case and the grievance of the petitioners, the official respondents are directed to complete the investigation and file a final report, without arresting the petitioners, if any crime is registered against them on the basis of the complaint of the 4th respondent. Further, if any crime is registered against the petitioners, they are directed to appear before the Station House Officer concerned as and when required and they are also directed to execute a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety each for the like sum each to the satisfaction of the Station House Officer concerned, as surety for their future appearance as and when required.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 9th December, 2016 Nn
