THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23483 OF 2011 ORDER:
This writ petition is filed seeking to issue a writ of Mandamus to direct the respondents to implement G.O.Ms.No.17, Irrigation & CAD (PW-COD) Department, dated 6.2.2004, amending clause 13(ii) of Annexure-I of G.O.Ms.No.94, Irrigation & CAD (PW-COD) Department, dated 01.07.2003, and consequently, to accept the tenders up to 25% less than the estimate and for tenders less by more than 25% of the estimate, accept a Bank Guarantee or Demand Draft for the difference between the tendered amount and 75% of the estimated contract value.
2. At the time of admission of the writ petition on 19.8.2011, this Court passed an interim order in W.P.M.P.No.28751 of 2011 as under: "As per the proceedings of the 5th respondent - Superintending Engineer, Panchayat Raj Circle, Eluru, West Godavari District, in Lr.Rc.No.AE2/NABARD RIDF XVL/WG/Kommuchikkakla/2011, dated 29.7.2011, the tender of the petitioner has been accepted @ 19.99% less than the Estimated Contract Value (ECV) of Rs.64,93,482.78 ps. Further, as per the orders issued in G.O.Ms.No.17, Irrigation & CAD (PW-COD) Department, dated 6.2.2004, the tenders upto 25% less than the estimate may be accepted.
Having regard to the said orders, there shall be interim direction, as prayed for."
3. No counter is filed by the respondents.
4. In view of the aforementioned interim order and by afflux of time, the cause in this writ petition does not survive for adjudication and hence, no further orders are required to be passed in this Writ Petition.
5. Accordingly, the Writ Petition is disposed of in terms of the aforementioned interim
order. There shall be no order as to costs.
