THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE DR JUSTICE SHAMEEM AKTHER Writ Petition No.3228 of 2017 ORDER: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} The relief sought for in this writ petition is to declare Rule 5(5) of the A.P. Forest Produce Rules, 1970, as amended by G.O.Ms.No.115 dated 27.12.2016, as irrational and unconstitutional. Learned Government Pleader for Forests has placed before us a copy of G.O.Ms.No.11 dated 30.01.2017 whereby, considering the representations of various user agencies, the Government decided to keep the orders issued in G.O.Ms.No.115 dated 27.12.2016 in abeyance until further orders. The Government also directed that, in the meantime, the rates for permit fee issued earlier in G.O.Ms.No.35 dated 06.02.2010 shall remain in force.
As the Rules, which are subjected to challenge in this writ petition, have been kept in abeyance, we see no reason to entertain the writ petition as at present. Leaving it open to the petitioner to question the amended Rules, in case the Government were to bring them into force later, the Writ Petition is dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed.
