The Court made the following:

ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for a mandamus to set aside the order, dated 02.03.2016, in S.A.No.267 of 2015 on the file of the Debts Recovery Tribunal, Visakhapatnam, directing the petitioner to deposit Rs.25 lakhs and also clubbing the conditions inter se between S.A.Nos.267 and 268 of 2015.

2. Smt.S.Madhavi, learned counsel representing Mr.C.Raghu, learned counsel for the petitioner, has requested for permission of the Court to withdraw the writ petition, with liberty to the petitioner to file an appeal before the Debts Recovery Tribunal under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short 'the SARFAESI Act').

3. Accordingly, the Writ Petition is dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.

4. As a sequel to dismissal of the writ petition, W.P.M.P.No.11169 of 2016 filed by the petitioner for interim relief shall stand dismissed as infructuous.
