THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.34551 OF 2013 ORDER:
Heard the learned counsel appearing for the petitioners and the learned Government Pleader appearing for the respondents 1 to 3.
The prayer sought for in the writ petition is as under: " to issue a writ or order or direction more particularly in the nature of writ of Mandamus declaring the action of the respondents 2 to 5 in interfering with the personal liberty of the petitioners to lead a peaceful marital life as illegal, arbitrary and violative of Article 19 and 21 of Constitution of India with a consequential direction, directing the respondents 2 and 3 not to interfere with the personal liberty of the petitioners to lead a peaceful martial life." During the course of hearing, the learned Government Pleader placed on record the written instructions dated 13.12.2013 issued by the Sub-Inspector of Police, Gurajala Police Station, Guntur District. The same is placed on record.
A perusal of the said written instructions would reveal that the 5th respondent herein lodged a complaint on 17.11.2013 leading to registration of Crime No.222 of 2013 on the file of Gurajala Police Station and investigation was taken up. During the course of investigation, three witnesses have been examined and their statements were recorded. The investigating officer deputed staff at probable places and has taken all necessary steps to trace out the missing girl. In the said instructions, it is specifically denied that the police have threatened the petitioners with dire consequences. Except registration of the above said crime, the respondents-police never harassed the petitioners nor interfered with their life and liberty at any point of time.
In view of the said statement, this Court is of the opinion that no further orders are required in this writ petition and the same is accordingly closed. No costs.
