O R D E R:
This Court by order dt.03.01.2014 in WP.MP.No.439 of 2014 in W.P.No.385 of 2014 directed respondents-authorities not to obstruct the movement of men and material of the petitioners as long as the petitioners comply with the orders of this Court dt.08.10.2013 in W.V.MP.No.2724 of 2013. Petitioners were also directed to cooperate with the respondent authorities and not to undertake any transportation activity during the period when military exercises are undertaken by the respondents.
2. Complaining that the above order is violated by the respondents by installing polls with barbed wire fencing on the road denying access to the property of the petitioners, this Contempt Case is filed.
3. Photographs filed along with the additional affidavit disclose that in front of the gate of the petitioners' property, barbed wire fencing was put up denying access to the road.
4. It is specifically contended by the learned Senior Counsel, Sri D.Prakash Reddy, representing Sri Avinash Desai, Counsel for the petitioners, that this action of the respondents in putting up barbed wire fencing denying access to the main road is in violation of the orders of this Court dt.03.01.2014.
5. On 12.10.2015 this matter was adjourned to this date to enable the respondents-authorities to report compliance of the orders.
6. When the matter is called today, the learned Senior Counsel, Sri Rao Raghunandan Rao, representing Sri Namavarapu R.Rao, counsel for respondents, submitted that the barbed wire fencing and
polls put up in front of the petitioners' gate are removed today in compliance of the orders passed by this Court and there is no bar for the petitioners to access the main road. He, however, tried to emphasis that only in order to protect the interests of the military installations, steps were taken by putting fencing, since sensitive military installations are located adjoining the road, but they are now removed.
7. Recording the same, this Contempt Case is closed. However, it is always open to the petitioners to prosecute the matter as and when disobedience of the order of this Court is noticed. No costs.
8. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
