Heard learned counsel for the petitioner and the learned Government Pleader for Prohibition & Excise.
According to the petitioner, he is a licencee of A4 shop at Door No.10-15-41 near Trunk Road, Kavali Municipality. He is aggrieved by shifting proposals submitted by the sixth respondent and, according to the petitioner, if the said proposal is considered positively by the respondents, the same will affect the business of the petitioner herein and having invested lakhs of rupees he will have to suffer irreparable loss and hardship. The material available on record discloses that the petitioner herein, in fact, submitted representations to the respondent Nos.3 and 4 in the said direction.
According to the learned counsel for the petitioner, without considering the said objections submitted by the petitioner, the respondent authorities are proceeding further with the grant of permission for shifting in favour of the unofficial respondent herein. Having heard the learned counsel for the petitioner and the learned Government Pleader, this Court, in the facts and circumstances of the case, deems it appropriate to dispose of the Writ Petition with a direction to the official respondents herein to consider the objections/representation, dated 07.09.2017, said to have been submitted by the petitioner herein and to take further action, strictly in accordance with law, at the time of considering the proposals, if any.
