This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the action of the respondents in not providing alternative employment in terms of section 47 of the Persons with disability (equal opportunities, protection of rights and participation) Act, 1995, inspite of repeated visits made by the petitioner followed by the written representation dt.11-02-2016,as being illegal, arbitrary & unjust and consequently direct the respondent to provide alternative employment i.e., As an Attender, Record Tressar, Rotein clerck or any other suitable post duly paying the salaries and other attendant benefits from the date of declaring unfit to till providing the alternative employment."
Heard Sri G. Rajesh, learned counsel for the petitioner and Sri N.
Vasudeva Reddy, learned Standing Counsel for respondents.
When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 1102-2016 to the 2nd and 3rd respondents herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 2nd and 3rd respondents to pass appropriate orders on the representation, dated 11-02-2016, in accordance with law, by fixing some timeframe. The said request is not opposed by the other side.
For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits of the matter and entitlement of the petitioner, directing the 2nd and 3rd respondents to consider and pass appropriate orders on the representation, dated 11-02-2016 said to have been submitted by the petitioner herein, in accordance with law, within a period of one month from the date of receipt of a copy of this order.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
