HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.25683 of 2016 ORDER:

Heard the learned counsel for the petitioner and learned Government Pleader for Home appearing for respondent Nos.1 to 3.

Petitioner's grievance is that without properly investigating into the Crime No.375 of 2015, the 3rd respondent had filed charge sheet before the X Metropolitan Magistrate at Cyberabad at Malkajgiri. Petitioner therefore seeks direction to the 2nd respondent to entrust the matter to CBCID or any other Investigating Agency for proper investigation by filing representation dt.29-06-2015.

3. Admittedly the petitioner has remedy under Section 173 (8) Cr.P.C. for seeking further investigation into the matter, if the petitioner is not satisfied with the investigation done by 3rd respondent, though such application needs to be submitted through the Public Prosecutor.

4. Therefore, the 2nd respondent is directed to give appropriate instructions to the concerned Public Prosecutor to examine the matter and file appropriate application under Section

173 (8) Cr.P.C. before the X Metropolitan Magistrate, Cyberabad at Malkajgiri so that the said Court can consider to seek further investigation in the matter.

5. With the above directions, the Writ Petition is disposed of. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
