The Hon'ble Sri Justice A.Rajasheker Reddy Writ Petition No.5820 of 2017 Order:

This Writ Petition is filed for a Mandamus to declare the action of respondent No.3 in passing the impugned proceeding in Roc.ROR/spl/Thorur/02, dated 15-03-2003, cancelling DKT.No.239/4/87, dated 26-10-1977, assigned in favour of petitioner No.1 and his father and assigning the same in favour of respondent Nos.4 and 5 as illegal, arbitrary and violative of the provisions of the A.P.Assigned Land (Prohibition of Transfers) Act, 1977. The petitioners sought for a consequential direction to set aside the same. Heard the learned Counsel for the petitioners and the learned Assistant Government Pleader for Revenue (AP) appearing for respondent Nos.1 to 3.

The learned Counsel for the petitioners submitted that as against the impugned proceeding cancelling their patta, the petitioners have already filed an appeal before respondent No.2, but, the same has not yet been disposed of.

ARR, J W.P.No.5820 of 2017 Dt: 20-02-2017 Having regard to the same, without going into the merits of the case, the Writ Petition is disposed of with the direction to respondent No.2 to dispose of the appeal, stated to have been filed by the petitioners, in accordance with law, after issuing notice to the petitioners and respondent No.5 and after affording an opportunity of hearing to both of them, within a period of eight weeks from the date of receipt of a copy of this order.

As a sequel to disposal of the Writ Petition, WPMP.No.7097 of 2017, filed by the petitioners for interim relief, is disposed of as infructuous.
