ORDER

The petitioner, who is A4, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Cr.No.13 o f 2016 of Chinna Chowk Police Station, Kadapa District, registered for the offences punishable Section 506 IPC and u/s.3(1)(x) of SCs & STs (POA) Act, 1989.

2. The case of the prosecution is that on 31.01.2016 at evening hours, when the informant and another were proceeding in front of the house of one Lakshmi Prasanna (A2), A1 scolded and abused them in the name of their caste. On the same day at about 7.30 PM., when they were returning, A2 also abused them in the name of their caste. On 01.01.2016 at 10.00 PM., when the informant and others went to the house of A1 and A2 and advised them to change their attitude, they attacked them with stones causing injuries. Again on 03.02.2016, while the informant was proceeding to her house, A3 and A4 abused her in filthy language and threatened her with dire consequences. Basing on these allegations, the above report came to be lodged.

3. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State.

Having regard to the facts and circumstances of the case and taking into consideration the circumstances under which the present report came to be lodged, the request of the petitioner/A4 cannot be considered. However, the petitioner/A4 is directed to appear before the Court concerned and move an application for bail after giving prior notice to the Public Prosecutor, in which

event, the Court concerned shall release the petitioner on bail on such terms and conditions as the court deems fit and proper.

5. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
