THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.21961 OF 2017 ORDER:
This writ petition is filed seeking to issue a writ of mandamus to declare the Public Auction Notice, dated 27.06.2017, issued by the 5th respondent for lease of endowments land to an extent of Acs.2.00 cents in Sy.No.82 in Rajavaram Village, Atreyapuram Mandal, East Godavari District, on 07.07.2017 at 10.00 a.m., belonging to Sri Venugopalaswamyvari Devasthanam, Rajavaram Village, Atreyapuram, Mandal, East Godavari District, as illegal and arbitrary and consequently, set aside the same.
When the matter is taken up for hearing, it is represented by the learned counsel for the petitioner that the petitioner has already filed an appeal before the authority concerned, challenging the notice which is questioned before this Court, and that he will also file an application for stay of the impugned notice before the authority concerned, and hence, prayed that this writ petition may be disposed of with a direction to the respondents not to take any further action, till his stay application is disposed of by the authority concerned. Considering the submissions of the learned counsel for the petitioner, this Writ petition is disposed of with the following directions: The petitioner is directed to file an application for stay of the impugned notice before the authority, before whom he preferred the appeal, on or before 26.07.2017, and till disposal of the said application by the authority concerned, the respondents are directed not to take any coercive steps in respect of the land in question.
Accordingly, the Writ Petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ______________ RAJA ELANGO, J July 20, 2017 KTL
