THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Contempt Case No.1636 of 2013 ORDER:

The order, violation of which is alleged in this Contempt Case, is the order passed in W.P.No.35512 of 2012 dated 19.11.2012, whereby the petitioner was permitted to file an application in the prescribed form for grant of pattadar pass books and title deeds within two weeks from the date of receipt of a copy of the order and the respondents were directed to consider the same and pass orders in accordance with law within two months thereafter. In the counter affidavit filed on behalf of the 2nd respondent, it is stated that the petitioner's application has been considered and as she did not have any title over the schedule property, an endorsement dated 23.03.2013 was issued to the petitioner to the said effect.

As the petitioner's request for grant of pattadar pass books and title deeds has been considered and an endorsement was given to her on 23.03.2013 that pattadar pass books and title deeds could not be issued, as she did not have title over the schedule property, the respondents cannot be said to have violated the order of this Court, much less willfully and deliberately. I see no reason, therefore, to proceed against the respondents under the Contempt of Courts Act. The Contempt Case is, accordingly, closed. The Contempt Applications, pending, if any, shall also stand closed. There shall be no order as to costs.
