Petitioner sought for the following prayer in the O.A.: "to declare that applicant is entitled to be included at the slots meant for ST's from the panel year 2002-03 to 2005-06 and non inclusion of his name in the proceedings of the 3rd respondent in C.No.E1/80/2010, dt: 13-8-2011 and in the proceedings of the 3rd respondent dt: 14-10-2011 and non inclusion of the name of the applicant in the above seniority list is illegal and arbitrary violative of article 14, 16, 16(4), 16(4-a); and to declare the rejection order dt: 15-6-2012 issued by the 3rd respondent in proceedings C.No.E1/ 126/2012 is in violation of article 14, 16, 16(4) of the Constitution of India."

When the matter is taken up for consideration, learned Government Pleader produced Memorandum of Deputy Inspector General of Police, Warangal Range, Warangal, vide C.No.E1/5/ 2016, dated 13.12.2016, which contains tabulated sheet bearing page no.27. Against Sl.No.505, the name of petitioner Sri A.Naresh Kumar was shown and in column No.15, it is recorded that he is granted notional promotion as Inspector from 21.05.2002. The prayer sought in the writ petition was to grant promotion from the panel year 2002-03 to 2005-06 in the vacancies meant for Scheduled Tribes. Since promotion was already granted from the retrospective date, which is the relief prayed by the petitioner, cause in the writ petition does not survive and writ petition is accordingly dismissed. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ JUSTICE P.NAVEEN RAO kkm
