THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN CONTEMPT CASE NO.1193 OF 2014 ORDER:

The order, violation of which is alleged in this Contempt Case, is the order passed in WP.No.16046 of 2014 dated 20.06.2014.

The said order required the Joint Collector, Kurnool District to dispose of the petitioner's appeal or the stay application filed therewith, in accordance with law at the earliest, and in any event not later than one month from the date of receipt of a copy of that order.

It is not in dispute that the petitioner's appeal was disposed of and, aggrieved thereby, the petitioner preferred a revision which was also dismissed. Sri R.Ramanjaneyulu, learned counsel for the petitioner, would contend that the order passed, as a consequence of the order of this Court, is not in accordance with the rules. The validity of the order passed by the authorities is not the subject matter of examination in contempt proceedings. The petitioner's remedy to question such an order is in independent legal proceedings. The order of this Court only required the respondent to pass an order, and as orders have been passed, the respondent cannot be said to have violated the order of this Court much less wilfully and deliberately.
