THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.32463 OF 2018 ORDER:

In this Writ Petition, under Article 226 of the Constitution of India, the only grievance of the petitioners is with regard to non-registration of a crime on the report/complaint, dated 27.07.2017, lodged by the petitioners with the Station House Officer, Mukkalapalli Police Station, Bhadradri-Kothagudem District/the 3rd respondent. 2.

I have heard the submissions of Sri V.Ramesh Reddy, learned counsel appearing for the petitioners; and of the learned Government Pleader for Home (Telangana) appearing for the respondents 1 to 3. I have perused the material record.

Learned counsel for the petitioners personally gave the report, dated 27.07.2017, to the 3rd respondent and sent a copy of the same to the Superintendent of Police, Bhadradri-Kothagudem District/2nd respondent herein as well as the 3rd respondent by post and that despite receiving the said report, no action has been taken and no crime has been registered and, therefore, the writ petition is filed. 4.

Learned Government Pleader for Home, on written instructions, dated 10.09.2018, a copy of which is placed on record, submits that the report, dated 27.07.2017, is said to have been lodged about more than a year back and that after lodging the said report, the petitioner did not approach the Police Station to enquire about his report and he also failed to submit a copy of the said report or a fresh complaint, but filed the present writ petition. He would further submit that the petitioner is an accused in three crimes.

Having regard to the submissions, the Writ Petition is disposed of reserving liberty to the petitioners to furnish a copy of the report, dated 27.07.2017, to the Station House Officer, Mulkalapalli Police Station/the 3rd respondent herein within a week from the date of receipt of a copy of this order. It is made clear that, in the event, the petitioners furnish a copy of the said report to the said Police Officer, as stated supra, the said Police Officer shall act on that report, in strict accordance with the procedure established by law, and do the needful in the matter following the precedential guidelines in Lalita Kumari v. Government of Uttar Pradesh1.

There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
