This petition is filed under Section 482 Cr.P.C., to quash the order dated 15.11.2016 in Crl.M.P.No.1261 of 2016 in C.C. No.9 of 2011 on the file of the Court of Principal Special Judge for ACB Cases, Visakhapatnam.

When the matter is called for hearing, learned counsel for the petitioner has sought permission of this court to permit the petitioner to withdraw the criminal petition with liberty to avail all the remedies available to him under law. He further submitted that while passing the impugned order, the trial court issued non bailable warrant against the petitioner. He also submitted that the trial court may be directed to dispose of the application to be filed by the petitioner under Section 70(2) of Cr.P.C., on the same day. Permission is granted.

Accordingly, the criminal petition is dismissed as withdrawn granting liberty as prayed. The trial court is hereby directed to consider and dispose of the application, if any, filed by the petitioner under Section 70(2) of Cr.P.C., on the same day, in accordance with law. Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
