HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.32332 OF 2018 ORDER :

This petition is filed for a writ of Mandamus declaring the action of the respondents in freezing the account of the petitioner which belongs to M/s.Sri Renuka Shakti Security Service Private Limited vide Account No.070611100001556 of Andhra Bank, Ashok Nagar Branch, Hyderabad, and another account bearing No.30101010003270, Syndicate Bank, Ashok Nagar Branch, Hyderabad, in respect of Crime No.215/2015, without having any relevance to the alleged crime, as illegal and arbitrary. The petitioner already filed Crl.MP.No.606 of 2016 in Crime No.215/2015 for de-freezing his account which was freezed by the Investigating Agency and the same was dismissed on merits on 23.06.2016. Without challenging the said order, the petitioner filed the present writ petition.

Learned counsel for the petitioner during the course of arguments stated that they have filed criminal petition against the said order and the same was withdrawn with liberty to file fresh writ petition.

But, the said fact was not mentioned in the writ affidavit nor a copy of the same is filed. More so, when petition filed by the petitioner for de-freezing his account is dismissed, no relief can be granted. Further, written instructions are produced by the

respondents stating implication of the petitioner in the crime. In view of the same, no relief can be granted in the writ petition. Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
