THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.15272 OF 2015 O R D E R :

Petitioner has assailed in this Writ Petition the action of the 3rd respondent in issuing an order dt.27.04.2015 suspending the petitioner as a Clerk in Diocesan Administrative set up in the Diocesan Treasurer's Office, Dornakal on the ground that he had misappropriated certain funds relating to the Church of South India, Diocese of Dornakal.

It is not shown by the petitioner that Diocese of Dornakal, Church of South India, would come within the definition of term 'State'

under Article of the Constitution of India for maintainability of a Writ Petition against its office bearers. 3.

Therefore, in my considered opinion, the Writ Petition against respondents 2 to 4 is not maintainable before this Court. 4.

Accordingly, the Writ Petition is dismissed granting liberty to the petitioner to avail any other alternative remedy available to him. No order as to costs.

Consequently, Miscellaneous Petitions pending if any, shall stand closed.
