THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2389 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/A-1 P.R.C.No.3 of 2016 pending on the file of Judicial Magistrate of First Class, Sullurpet for the offences punishable under Section 143, 307, 363, 323 and 506 read with Sections 149, 109, 114 IPC and Sections 3 (1) (x) of SC ST (Prevention of Atrocities) Act, 1989.

Heard the learned counsel for the petitioner/A-1 and the learned Public Prosecutor and perused the material available on record.

After arguing for sometime, the learned counsel for the petitioner, while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner before the trial Court.

In any event, considering the facts and circumstances of the case, the presence of the petitioner/A-1 before the trial Court is dispensed with except on the dates when his presence is essentially required by the Court and the petitioner shall be properly represented by his counsel.

With the above observation, this criminal petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
