HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.2554 of 2017 ORDER:

This criminal petition is filed by the petitioner/ A.1 under Section 438 Cr.P.C. to direct the Station House Officer, Nizamabad Rural PS, to release him on bail in the event of his arrest in connection with Cr.No.39 of 2017, registered for the offence punishable under Section 420 of IPC.

2. After arguing the matter for some time, Sri K.B. Ramanna Dora, learned counsel for the petitioner, requested this court to permit the petitioner to surrender before the concerned court having jurisdiction and on such surrender, if any bail application is filed, the Presiding Officer may be directed to decide the bail application on the same day.

3. Acceding the request of the learned counsel for the petitioner, without touching the merits of the case, the petitioner is directed to surrender before the court having jurisdiction and in the event of filing of any application by the petitioner under Sections 437 and 439 of Cr.P.C. after giving notice to the Public Prosecutor, the Presiding Officer is directed to decide the bail application in accordance with law on the same day.
