THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34851 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of respondent Nos.3 and 4 in interfering with personal life and liberty of petitioners by threatening them with dire consequences under the guise of counselling before Family Counselling Center, Srikakulam on a report given by respondent No.5 as illegal and arbitrary and consequently, to pass an order which this Court may deem fit and proper.

Heard and perused the material available on record. 3.

Learned Assistant Government Pleader for Home denied the entire allegations and submitted that respondent Nos.3 and 4 never interfered in the affairs of the petitioners and only with an intention to settle the dispute pending before the petitioners and respondent No.5, they were called to the police station and it is for the petitioners to decide the issue on their own. 4.

Considering the facts and circumstances of the case, this Court is of the view that the writ petition can be disposed of with the following direction:

Respondent Nos.3 and 4 are hereby directed not to harass the petitioners while investigating the matter and if at all they want to call the petitioners to the police station, they have to issue notice under Section 41-A Cr.P.C. and proceed in accordance with law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
