CRIMINAL PETITION NO. 1522 OF 2017 O R D E R :

The petitioners/A-1 and A-2 seeking anticipatory bail in Crime No.301 of 2016 on the file of Nakrekal Police Station, Nalgonda district, wherein they were charged for the offences punishable under section 417, 418, 420, 423, 506, 120-B of IPC.

2. Heard.

3. Learned Additional Public Prosecutor would submit that apart from the present offences, similar offences were charged against A-2, who is the husband of A-1 in Crime No. 19 of 2017 and Crime No. 15 of 2014 of Nakrekal Police Station and in that view, he would argue that the petition may be dismissed.

4. Learned counsel for the petitioners would submit that the first petitioner is a lady and the second petitioner is her husband and they have not committed any offence and they were falsely implicated in this case.

5. Having regard to the fact that crimes were registered against the second petitioner/A-2, anticipatory bail is refused to the second

petitioner/A-2. However, considering the fact that the first petitioner/A-1 is a lady, she is not involved in other related offence, anticipatory bail is granted in her favour.

6. Accordingly, the petition is partly allowed and the first petitioner/A-1 is directed to surrender before the Judicial Magistrate of First Class, Nakrekal, Nalgonda district, on or before 07/03/2017 and on such surrender she shall be enlarged on bail on her executing a personal bond for Rs.10,000/- with two sureties for the like sum each to the satisfaction of Judicial Magistrate of First Class, Nakrekal. The first petitioner/A-1 is directed to appear before the Station House Officer, Nakrekal Police Station, Nalgonda district, on every Monday between 10:00 a.m. and 12:00 noon till charge sheet is filed. The bail application is dismissed in so far as petitioner No.2/A-2 is concerned.

7. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
