THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 12703 of 2011 ORDER:
This Writ Petition was filed alleging inaction on the part of the Station House Officer, Satyavedu Police Station, Chittoor District, in investigating into Crime No.96 of 2009 and in filing a report/charge sheet against respondents 4 to 7 herein. Basing on the written instructions dated 27.05.2011 received from the Station
House Officer, Satyavedu Police Station, Chittoor District, the learned Assistant Government Pleader for Home stated that pursuant to the investigation in Crime No.96 of 2009 registered under Sections 365 and 497 I.P.C, the fifth respondent herein, accused No.2 in Crime No.96 of 2009 was arrested and sent to judicial custody. Pursuant to the order dated 01.02.2010 passed by the learned Special Sessions Judge-cum- IV Additional District and Sessions Judge, Tirupati, in Cril.M.P.No.25 of 2010 in Crime No.96 of 2009 of Satyavedu Police Station, accused Nos.3 and 4, respondents 6 and 7 herein, surrendered and were thereafter granted bail. The Station House Officer further stated that accused No.1, the fourth respondent herein, was absconding and efforts were being made to apprehend him. In the light of the aforestated facts, it is clear that there is no basis for the petitioner's allegation that the police did not investigate the case in Crime No.96 of 2009.
The Writ Petition is therefore closed.
Pending Miscellaneous Petitions shall also stand closed. No order as to costs.
