Heard counsel for the petitioner/ A3, among about 12 accused of C.C.No.275 of 2016 pending on the file of petitioners/ A1 to A7 of VI Additional Chief Metropolitan Magistrate at Nampally, where the learned Magistrate has taken cognizance for the offence punishable under Section 420, 384, 506, 467, 468, 471 and 120-B r/ w 34 IPC, outcome of the crime NO.36 of 2012, dated 21.05.2012, from the report of the 2nd respondent-de facto complainant and also heard the Public Prosecutor representing the State. Perused the FIR, charge sheet, and the grounds urged in the quash petition. Indisputably, there is no part-II Case Diary filed.

The material is incomplete even for disposal on merits and further remedies therefrom left open. Needless to state, if at all any application is filed by the petitioner under Section 265 Cr.P.C., to represent through Special Vakalat Holder, the learned Magistrate can consider.
