The petitioner assails the action of the Station House Officer, Mothugudem Police Station, Khammam District, in causing his arrest along with others pursuant to F.I.R. No.47 of 2009 registered on the file of the said Police Station at the behest of one Vaddi Kameshwara Rao, the 3rd respondent herein, who thereafter compromised the matter with him. The petitioner therefore sought quashing of the said F.I.R. By order dated 07.07.2011, this Court took note of the fact that the subject crime No.47 of 2009 was registered on the file of the Station House Officer,

Mothugudem Police Station, Khammam District, upon the complaint made by the 3rd respondent herein, but Sri Ch. Ramesh, learned counsel for the 3rd respondent herein, produced a copy of the compromise arrived at between his client and the writ petitioner. This Court accordingly stayed all further proceedings pursuant to the said F.I.R.

The Sub-Inspector of Police, Mothugudem Police Station, Khammam District, furnished written instructions dated 24.02.2014 to the office of the learned Government Pleader, wherein he referred to the afore-stated facts and stated that investigation was not taken up after the stay granted by this Court. As the offence was sought to be registered upon the complaint made by the 3rd respondent who thereafter compromised the matter with the petitioner, this Court sees no purpose being served by the police authorities expending valuable time in investigation thereof.

F.I.R.No.47 of 2009 on the file of the Station House Officer, Mothugudem Police Station, Khammam District, is accordingly quashed. The writ petition is allowed.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
