THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.115 OF 2013 JUDGMENT:

This Second Appeal is filed by the unsuccessful plaintiffs, under Section 100 of C.P.C., assailing the judgment and decree dated 24.06.2009 passed in A.S.No.84 of 2006 on the file of the Court of the Chief Judge, City Civil Court at Hyderabad, wherein and whereby the judgment and decree dated 17.10.2005 passed in O.S.No.871 of 2003 on the file of the Court of the Additional Judge, City Small Causes Court-cum-VI Senior Civil Judge, City Civil Court at Hyderabad, dismissing the suit filed by the plaintiffs for mandatory injunction, was confirmed.

Learned counsel for respondent Nos.4 and 6 is present on 25.10.2018, 29.10.2018 and today.

No representation on behalf of the appellants on 25.10.2018 and 29.10.2018. Today also, no representation on behalf of the appellants even though the matter is listed under the caption 'for dismissal'. It seems that the appellants are not interested to prosecute the appeal.

Hence, the Second Appeal is dismissed for non-prosecution. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed.
