ORDER:
This Writ Petition is filed for a Mandamus to declare the action of respondent No.3 in not considering the petitioner's request for her transfer from H.Kairavadi Centre-III to H.Kairavadi Centre-I.
It is the pleaded case of the petitioner that she was appointed as Anganwadi Worker in H.Kairavadi Centre-III in 'OC' vacancy though she belongs to S.C. category; that one Ms. M.Ravi Kumari who was appointed as Anganwadi Worker of H.Kairavadi Centre-I, reserved for
Scheduled Caste, has retired; that she has made a representation, dated 05.9.2015, requesting respondent No.3 to transfer her to the said centre; that respondent No.3 issued notification on 04.10.2015 calling for applications for filling up the vacancy of H.Kairavadi Centre-I; and that she apprehends that respondent No.3 may without considering her request for transfer, fill up the vacancy of H.Kairavadi Centre-I with a new applicant. In my opinion, when a vacancy of Anganwadi Worker arises, the request of an Anganwadi Worker who is working in the adjacent area deserves to be considered for transfer if no complaints are pending against such applicant. As the petitioner has come out with proper reasons for making her request, viz.
, that she being a Scheduled Caste person will feel more comfortable, if she is allowed to function in a vacancy reserved for Scheduled Caste category, her request deserves positive consideration. Therefore, respondent No.3 is directed to consider the petitioner's representation for transfer to H.Kairavadi Centre-I and appoint a new applicant for H.Kairavadi Centre-III.
Subject to the above direction, the Writ Petition is disposed of.
