HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT PETITION No.43142 of 2016 ORDER:

This Writ Petition is filed seeking a writ of mandamus declaring the inaction of respondent Nos.2 and 3, in registering the complaint dated 11.11.2016 and conducting investigation against respondent No.4, is questioned as illegal and arbitrary.

Learned Counsel for the petitioners submits that respondent No.4 is interfering with the possession of petitioners despite an order of injunction in I.A.No.29 of 2005 in O.S.No.5 of 2005. He seeks to withdraw the Writ Petition with liberty to avail appropriate remedies available to them in law.

Learned Assistant Government Pleader for Home submits that the complaint, however, does not mention with regard to trespass into the petition schedule property. Without going into the merits of the petition, and permitting the petitioners to avail appropriate remedies available to them in law, the Writ Petition is dismissed as withdrawn.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
