2016-04-21M.S.Ramachandra Rao2 pages

HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO W.P.No.13497 of 2016 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue, appearing for respondent Nos.1 to 4.

2.

Petitioners' grievance is that in respect of land in Sy. No.187 of Peddapur village, Korutla Mandal, Karimnagar District belonging to them, the name of 4th respondent had been entered in the revenue record by 3rd respondent in the year 2005 and that the petitioners had approached 3rd respondent on 20-01-2016 by way of representation to restore their names by deleting the name of 4th respondent.

3.

Learned Government Pleader for Revenue appearing for respondent Nos.1 to 3 states that the competent authority to take action after this lapse of time is the District Collector, Karimnagar and that 3rd respondent to whom the representation has been made by the petitioners cannot take any action at this point of time in view of the judgment in G.Prabhakar Vs. The State of Telangana and others[1].

4.

This legal decision is not disputed by the

learned counsel for the petitioners.

5.

Therefore, the petitioners are directed to make a fresh application before the District Collector, Karimnagar District in respect of their grievance and the District Collector, Karimnagar, is directed to dispose of any representation made by the petitioners in this regard within eight weeks from the date of receipt of the said representation from the petitioners.

6. Accordingly, the Writ Petition is disposed of. No costs.

7.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
