HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.2872 of 2015 ORDER:

The petitioner, who is accused No.1, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.69 of 2013 of Balaji Nagar Police Station, Nellore, registered for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

By an order dated 16.02.2015, this Court directed the petitioner to appear before the concerned Court within one month from that day and move an application for recall of the non-bailable warrant issued against him on 07.11.2013, in which event the same was directed to be dealt with on the same day on certain terms and conditions which that Court deems fit and proper. Learned counsel for the petitioner submits that the petitioner could not comply with the said condition as his employer did not grant him leave. It is now stated that the petitioner is coming to India and that he will abide by all conditions. Having regard to the said circumstances, the petitioner herein is directed to appear before the concerned Court within three weeks from today and move an application for recall of the non-bailable warrant issued against him on 07.11.

2013, in which event the same shall be dealt with in accordance with law on the same day on such terms and conditions which that Court deems fit and proper.
