THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.32494 of 2018 ORDER:

Heard learned Counsel for the petitioner and the learned Government Pleader for Mines and Geology for the State of A.P. for the respondents.

Non-disposal of quarry lease application filed by the petitioner herein for grant of lease in respect of an extent of 3.000 Hects., in Sy.No.721/4-P3 of Meedipentla village, Vemula Mandal, Y.S.R.Kadapa District, for Barytes & Dolomite mineral is under challenge in the present Writ Petition.

A perusal of the material available before this Court discloses in clear and vivid terms that the Assistant Director of Mines and Geology, Yerraguntla, YSR Kadapa District, received the said application of the petitioner herein vide acknowledgment bearing No.2896/QL/2016, dated 16.08.2016.

Today, when the matter is taken up, written instructions furnished by the Assistant Director of Mines and Geology/R.3 herein are placed on record by the learned Government Pleader, which shows that after receipt of the above said application from the petitioner herein, the Office of the 3rd respondent forwarded the copy of the application vide Lr.No.2896/QL/2016, dated 16.08.2016, to the Tahsildar, Vemula Mandal, YSR Kadapa District, with a request to inform about the classification and availability of the area applied and to issue No Objection Certificate for grant of quarry lease. It is further stated in the said written instructions that till date, the Tahsildar has not issued any No Objection Certificate. It is further stated that soon after receipt of

the No Objection Certificate from the Tahsildar, the petitioner's application, filed on 16.08.2016, would be processed according to Rules.

Since, the No Objection Certificate is awaited from the Office of the Tahsildar, this Court deems it appropriate to Order impleadment of the Tahsildar, Vemula Mandal, YSR Kadapa District, sue motu as respondent No.4.

Since the petitioner herein submitted his application, as long back as on 16.08.2016, this Court does not find any justification on the part of the respondent-authorities in not passing any final Orders on the said application, despite lapse of considerable length of time.

Having heard the learned Counsel for the petitioner and the learned Government Pleader, this Court deems it appropriate to dispose of the Writ Petition, directing the respondent-authorities to process the application of the petitioner herein, dated 16.08.2016, for grant of quarry lease for Barytes & Dolomite minerals in respect of an extent of 3.000 Hects., in Sy.No.721/4-P3 of Meedipentla village, Vemula Mandal, Y.S.R.Kadapa District, and pass final orders, as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
