When the matter came up for hearing, the learned counsel for the petitioner represented that the matter become infructuous and the present criminal petition no way survives and as such the petition becomes infructuous.

3) In the result, the petition is dismissed as infructuous. Needless to say that the remedy, if any, is left open to the petitioner.
