HONOURABLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.2209 OF 2015 ORDER:

This Contempt Case is filed complaining non-compliance of the order dated 09.02.2015 passed in WP MP No.3380 of 2015 in WP No.2530 of 2015, which reads as under:

"The grievance of the petitioners is that the respondent authorities having mutated the name of the petitioners as purchasers and having issued Pattadar Passbook had fialed to grant title deeds, which is required to be done as a matter of course under Section 6A of the A.P.right in Land and Pattadar Passbooks Act, 1971 (in short, "the Act").

The learned Government Pleader seeks time to get instructions.

The respondents are directed to comply with the provisions of the Act if the petitioners are otherwise entitled to or would communicate the reasons why the request of the petitioners is not been acceded to. The entire process shall be completed by the respondents within six weeks from today, failing which adverse inference would be drawn against them." 2.

A careful reading of the order discloses that this court directed the respondents either to take action in terms of the Act or at least communicate the reasons for not acceding to the request of the petitioners.

3. It is not in dispute that pursuant to the order, by endorsement dated 16.03.2015 the respondents have rejected the request of the petitioners citing the circular issued by the Commissioner. Inasmuch as the reasons for not complying with the application of the petitioners for grant of title deeds has been stated, the order dated 09.02.2015 of this Court stands complied with leaving it open to the petitioners to challenge the same if they are otherwise aggrieved.

4. Though a counter affidavit has been filed in this contempt,

it is not necessary for this court to advert to the contents of the counter affidavit as the order itself stands complied with. The Contempt Case is closed. As a sequel, the miscellaneous petitions, if any, shall stand closed in the light of this final order.

No order as to costs.
