HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43945 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the respondents in not closing the Rowdy Sheet against the petitioner by considering of representation, dated 02.12.2016, as illegal and arbitrary and consequently direct the respondents to consider the representation of the petitioner, dated 02.12.2016. Heard and perused the material available on record. The case of the petitioner is that the petitioner is a social worker and was elected as a counselor to the Malkajgiri Municipality for the years 2000-2005. Most of the cases registered against the petitioners are at the instance of third parties, who claim to be lessees from the A.P. Wakf Board in respect of the individual plots in Survey Nos.418, 419, 420, 403/1, 2 and 3 at Moula Ali, Malkajgiri, Hyderabad. The case in Crime No.106 of 2015 for the offences under Sections 447 & 506 IPC was closed and the case in FIR No.515 of 2015 was resulted in acquittal by order, dated 25.11.2016.

The petitioner submitted a representation, dated 02.12.2016, to the respondents requesting them to close the Rowdy Sheet opened against him, but till now, the respondents have not considered the same and that if the said representation is not considered by the respondents, then the petitioner would suffer severe hardship.

Learned counsel for the petitioner submitted that the petitioner, who is aged about 62 years, is suffering from severe ailments and he has been hospitalized for treatment. Learned counsel for the petitioner further submits that only three cases are

pending against the petitioner i.e., FIR Nos.5 of 2016, 495 of 2016 & 595 of 2016 and all the remaining cases have been closed. Considering the grievance of the petitioner and the submissions of the learned counsel for the petitioner, the petitioner is directed to make a representation to respondents 2 & 3 informing the grounds on which Rowdy Sheet opened against the petitioner should not be continued against the petitioner and that he is not involved in any other crime except the crimes registered in FIR Nos.5 of 2016, 495 of 2016 & 595 of 2016. On such representation, respondents 2 & 3 are directed to consider and dispose of the same, in accordance with law, as expeditiously as possible, within a period of two (2) months from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO, J Date: 16th December, 2016 KL
