HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 3587 OF 2013 ORDER :

This Writ Petition is filed to declare the action of the authorities of the respondent corporation in making markings and proposing to lay the road through the middle of lands of the petitioners in Sy.No.1016 admeasuring Ac. 0-10 Gts., situated at Srinagar Colony of Karimnagar Town, without issuing any notice and without following the due process of law as illegal and arbitrary.

2. This Court, on 07.02.2013, directed the parties to maintain status quo existing as on that date.

3. When the matter is taken up for hearing today, learned Standing Counsel orally submitted that the subject land is a Government land.

4. Heard Mr. N.Hari Prasad, learned counsel for the petitioner and Mr.R.A. Chary, learned Standing Counsel for the Municipality.

5. In view of the categorical statement made by the learned Standing Counsel for Municipality that the subject land is a Government land and as disputed questions of facts are involved, petitioner is permitted to work out his remedies in accordance with law.

6. The Writ Petition is, accordingly, closed. No costs.
