THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.30175 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents 2 to 4 in proposing to establish/locate the government outlet at Madapam Village, Narsannapeta Mandal within the Prohibition and Excise Station limits of Narsannapeta, Srikakulam District without notifying the same as per Rules and also in addition to the outlet notified at Ward No.19, Narasannapeta village and Mandal, Srikakulam District vide Notification in Rc.No.162/2015/A2 dt.22-06-2015 as illegal, contrary to Rules and violative of Art.19(1)(g) of the Constitution of India and consequently direct the respondents 2 to 4 not to establish or locate the government outlet at Madapm Village, Narasannapeta Mandal, Srikakulam District."

Heard Sri K. Chidambaram, learned counsel for the petitioners and learned Government Pleader for Excise for respondents, apart from perusing the material available before this Court.

Today, when the matter is called, written instructions, dated 23-09-2015 furnished by the Prohibition and Excise Superintendent, Srikakulam have been placed on record by the learned Government Pleader for Excise. In the said instructions it is stated that "without notification by the District Collector, Srikakulam with the prior approval of the Commissioner of Prohibition and Excise A.P., Hyderabad the Government retail outlet proposed at Madapam village will not be opened."

On noticing the above said instructions, learned counsel for the petitioners has requested this Court to record the said instructions and dispose of the writ petition. In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 23-09-2015 furnished by the Prohibition and Excise Superintendent, Srikakulam. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. There shall be no order as to costs. ___________________ A.V.
