THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.5887 of 2016 ORDER:

The present application is filed under Section 438 of the Code of the Criminal Procedure (Cr.P.C.), seeking release in the event of arrest of the petitioner in connection with an unregistered crime. The facts in issue are that the petitioner who is resident of Chirala, Prakasam District apprehends that his wife, who has left his company, is likely to file a criminal case against him with a view to see that he loses his job.

In view of the above, the respondent-police are directed to issue notice under Section 41-A of Cr.P.C. and also follow the directions issued in the judgment of the Apex Court in Arnesh Kumar v. State of Bihar and another[1], if any crime is registered for the offences which are punishable for a period of less than 7 years, in respect of a case to be registered at the instance of one Venkata Padmavathi, W/o. Kavuri Srinivas Rao, before taking any coercive steps against the petitioner. With the above direction, the Criminal Petition is disposed of.
