HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32592 of 2018 ORDER:

1) Heard learned counsel for the petitioners and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.4 in mutating the names of unofficial respondents in the revenue records vide proceedings Rc.No.280/2018-B, dated 11.04.2018, as illegal and arbitrary.

3) A perusal of the material on record would show that against the order of the Tahsildar, an appeal under Section 5-B of A.P.Rights in Lands and Pattadar Pass Books Act, 1971, came to be filed by the petitioners before the Revenue Divisional Officer-cum-Sub Divisional Magistrate, Guntur, and the same is pending consideration. The said appeal was also numbered as Appeal No.3010 of 2018.

4) Having regard to the above, learned counsel for the petitioner would submit that a direction may be given to the Revenue Divisional Officer to dispose of the appeal, at the earliest.

5) Learned Government Pleader would submit that if the said appeal is still pending, the Revenue Divisional Officer, may be directed to pass orders, in accordance with law, at the earliest.

6) Recording the said submission, the writ petition is disposed of directing the Revenue Divisional Officer - respondent No.3 to pass appropriate orders, in the appeal No.3010/2018, filed by the petitioners, in accordance with law, as early as possible, preferably within a period of three months from the date of receipt of a copy of the order, after hearing all the concerned, if the same is still pending consideration.
