HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.18954 OF 2016 ORDER:

This Writ Petition is filed challenging the action of 2nd respondent in suspending the authorization of the petitioner vide proceedings dated 30.05.2016 on the ground that the Inspecting Authority found that there is a variation of 207 ltrs of kerosene and 36 kgs of Atta and the variation is beyond the permissible limits.

A perusal of the record shows that the petitioner had already delivered the scheduled commodities to the card holders, but, however, there was a ground balance which exceeds 2% of permissible limit. In those circumstances, suspension pending enquiry has been ordered. As there is a variation of stock and serious allegations leveled against the petitioner, the matter is required to be enquired into by the respondent-authorities and as such the suspension pending enquiry cannot be interfered with at this stage. In those circumstances, the writ petition is disposed of directing the 2nd respondent-R.D.O to consider the explanation submitted by the petitioner and complete the enquiry after giving the adequate opportunity to the petitioner and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.
