THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.580 of 2013 ORDER:

The petitioner-A5 filed the above Criminal Revision Case against the order dated 21.1.2013 passed by the Principal Special Judge for CBI Cases, Hyderabad allowing the memo and taking cognizance of the offence under Sections 13(2) r/w 13(1)(c )&(d) of the Prevention of Corruption Act against A5. This Court allowed the above Revision and set aside the order dated 21.1.2013 passed by the Principal Special Judge for CBI Cases. Against the order of this Court in the above revision case dated 29.4.2013, the State preferred appeal before the Hon'ble Supreme Court. The Hon'ble Supreme Court allowed the appeal setting aside the order dated 29.4.2013 passed by this Court in the above revision case and remanding the matter to this Court to consider the case afresh and decide the issue whether there was a necessity of having prior sanction under Section 19 of the PC Act or not.

When this matter was posted for hearing, the learned Counsel for the petitioner sought permission of this Court to withdraw the above revision case with a liberty to raise the above issue of necessity of prior sanction, before the trial Court either at the time of filing of discharge application or at the time of trial.

Permission is accorded.

Granting liberty to the petitioner to raise the above issue before the trial Court, the Criminal Revision Case is disposed of as withdrawn. Consequently, miscellaneous petitions pending, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO Dated:26th September, 2016 Nn
