THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21278 of 2016 ORDER :

This Writ Petition came to be filed with the following prayer:

"...to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the 2nd respondent herein on the representation dated 13.06.2016 made by the petitioner herein in respect of stoppage of further construction being made by 4th respondent herein and to demolish the structures already raised by 4th respondent herein in Sy. No.761, situated at H.No.86-301/4/A, Rampur locality, bye-pass road within the limits of Municipal Corporation, Karimnagar, as arbitrary, illegal and contrary to Hyderabad Municipal Corporation Act, 1955 and the rules made thereunder and violative of Article 14 and 19 of the Constitution of India with a consequential direction to 2nd respondent herein to dispose of representation dated 13.06.2016 made by the petitioner herein, and pass..."

2. Heard the learned counsel for the petitioner and Sri V.Satyam Reddy, learned Standing Counsel for respondents 2 and 3. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission. Since this Court is not adjudicating the case on merits, it may not be necessary to hear unofficial respondent No.4.

3. Though various grounds are urged in the Writ

Petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondent No.2 to consider and pass appropriate orders on the representation dated 13.06.2016 made by the petitioner. On the other hand, learned Standing Counsel appearing for respondents 2 and 3 states that the respondent No.2 has to take appropriate action on the representation dated 13.06.2016 made by the petitioner.

4. In view of the same, without going into the merits of the case, the Writ Petition is disposed of directing the respondent No.2 to consider and pass appropriate orders in accordance with law on the representation dated 13.06.2016 made by the petitioner, as early as possible preferably within a period of four weeks from the date of receipt of a copy of this order, after giving opportunity of hearing to the petitioner and all aggrieved persons. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
