The grievance of the petitioner was that the police authorities were summoning him and detaining him at the police station though no crime had

been registered against him.

By order dated 20.07.2011, this Court directed that the petitioner should not be called to the police station as no crime had been registered against him. While so, the Sub-Inspector of Police, Bahadurpura Police Station, Hyderabad, filed a counter affidavit stating that a case in Crime No. 97 of 2011 had been registered under Sections 406 and 420 I.P.C. against one Anand Kiran, Project Manager, MPM Group on the file of the Bahadurpura Police Station, Hyderabad, and during the course of the investigation, the role of M/s. V.K. Steels, Nacharam, was required to be looked into. In that context, it came to light that the owner of M/s. V.K. Steels was Vinod Kumar Singh, the petitioner herein.

The Sub-Inspector further stated that the investigation was at its initial stage and it was yet to be established that the petitioner had any complicity in the alleged offence. He denied that the petitioner was forcefully taken to the police station and detained there during day and night. In the light of the aforestated facts, the police would necessarily have to adhere to the due procedure laid down in the Code of Criminal Procedure in the event investigation into the subject crime requires summoning and questioning of the petitioner.

Reserving liberty to the police authorities to do so, the writ petition is closed.

Pending miscellaneous petitions shall also stand closed. No order as to costs.
