THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON No.32572 OF 2018 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The petitioner is the unsuccessful applicant in O.A.No.1647 of 2018 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. His prayer therein was to direct the State of Andhra Pradesh to dispose of his appeal dated 02.11.2017. By order dated 16.08.2018, the Tribunal dismissed the O.A. opining that there was no need to hustle the Government on the petitioner-applicant's appeal dated 02.11.2017. It appears that the petitioner-applicant made representation dated 03.10.2016 to the Director of Public Health and Family Welfare, Andhra Pradesh, in relation to his promotion and the same was rejected vide order dated 20.07.2017.

Aggrieved thereby, he filed the subject appeal before the Government, the appellate authority. Considering the fact that the petitioner is a retired employee and presently aged 66 years, we are of the opinion that this is a fit case where the appellate authority should give priority of hearing to the petitioner/applicant's appeal and dispose of the same as expeditiously as possible.

There shall accordingly be a direction to the appellate authority, the second respondent herein, to dispose of the petitioner-applicant's appeal dated 02.11.2017 on its own merits and in accordance with law expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.

The writ petition is disposed of with the above direction.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _________________ SANJAY KUMAR,J _________________ M. GANGA RAO, J Dt: 11.09.2018 IBL
