HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.1191 of 2015 ORDER:

The present application is filed under Section 438 Cr.P.C., seeking release in the event of the arrest of the petitioner in an unregistered crime. Learned Public Prosecutor on instructions, submits that on 27.10.2014, a case in Crime No.331 of 2014 was registered in which the petitioner is not an accused. But the learned counsel for the petitioner submits that pursuant to the orders passed by the Institution of Lokayukta for the States of Andhra Pradesh and Telangana, dated 29.01.2015, a criminal case is registered against the petitioner. Learned Public Prosecutor on instructions states that so far no complaint has been received pursuant to an order passed by Hon'ble Lokayukta.

In view of the above, I see no reason to consider the request of the petitioner, at this stage. However, it is always open to the petitioner to make an application for anticipatory bail subsequent to the registration of crime.
