ORDER

This writ petition is filed challenging the inaction of the 2nd respondent in conducting the investigation in a fair manner in Cr.No.263 of 2016.

A counter-affidavit is filed on behalf of the 2nd respondent stating that Cr.No.263 of 2016 was registered on 24.12.2016, investigation is in progress and the 3rd respondent in the present writ petition was shown as A4. During the course of investigation, the 2nd respondent examined the complainant and some other witnesses and recorded their statements. Based on their evidence, A1 and A2 were arrested on 2.1.2017 and were sent to judicial custody. But, there is no evidence with regard to involvement of A3 and A4. Hence, proposals were submitted to the higher authorities seeking deletion of their names and the same is pending consideration. Now, investigation is also pending for want of FSL report. As and when the same is received, appropriate action would be taken in the present case.

In view of the same, the Writ Petition is disposed of directing the 2nd respondent to complete the investigation as expeditiously as possible. Since the Investigating Officer

came to the conclusion that there is no involvement of A3 and A4, it is open to the petitioner to produce any evidence or information with regard to involvement of the 3rd respondentA4. The Investigating Officer shall take into account the same before preparing the final report.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
