THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14574 of 2025 ORDER:
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused in Crime No.168 of 2025 before the RPSMahabubnagar (RPS - Secunderabad) Police Station, GRP Secunderabad.

The brief facts of the case are that the petitioners have stated that on 06.10.2025 at about 08:00 hours, a death message was received from Dr. Sravya, On-Duty Medical Officer, Gandhi Hospital, Secunderabad, informing that one K. Ramulu, aged 32 years, was brought to the casualty with head injuries alleging a train accident and was declared dead on 05.10.2025 at 22:47 hours. Based on this information, a case was registered in Cr.No.168 of 2025 under Section 194 BNSS for investigation. The petitioners further stated that the de facto complainant later lodged a false case against them as a counterblast to FIR No.101 of 2025 of P.S. Narva, which had
been filed regarding the killing of the sister of accused No.4. It was asserted that the deceased, fearing lawful prosecution for the said killing, had committed suicide and not due to any instigation by the petitioners.

Heard Sri T. Rahul, learned counsel appearing on behalf of the petitioners as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that all allegations against the petitioners were false, fabricated, and motivated by ulterior reasons and that there were no essential ingredients of abetment under Section 45 or 108 BNS, as there was neither mens rea nor any specific overt act attributed to the petitioners. He further submitted that the alleged words spoken by petitioners were mere expressions of grief and not instigation. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioners stating that the allegations leveled against the petitioners are serious in nature. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioners does not arise. Therefore, he prayed the Court to dismiss the Criminal Petition. 6.
In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, it appears that the father of the deceased had earlier lodged a report before the Narva Police Station, based on which Crime No.101 of 2025 was registered on 03.10.2025 for the offences under Sections 85 and 108 of BNS. The record further shows that the deceased, who was apprehending prosecution in connection with the said case, subsequently committed suicide. It also appears that the present complaint was lodged thereafter as a counterblast, alleging abetment against the petitioners. Having regard to the sequence of events, nature of allegations, and stage of investigation, this Court is of the considered view that custodial interrogation of the petitioners is not warranted.
Therefore, this Court deems it appropriate to grant pre-arrest bail to the petitioners, subject to the following conditions: i.
The petitioners shall surrender before Station House Officer, RPS Mahabubnagar, Mahabubabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- each, with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge
sheet and thereafter, as and when required 7.
Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
