HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 5 3 8 8 of 2 0 1 8 ORDER: - When the matter is taken up, the learned Standing Counsel appearing for the High Court has placed on record a letter, dated 09.11.2018, addressed by the Chief Metropolitan Magistrate, Visakhapatnam, to the Registrar (General), High Court of Judicature for the State of Telangana and the State of Andhra Pradesh, Hyderabad, through the Principal District Judge, Visakhapatnam. The operative portion of the said letter, which is relevant for the present Writ Petition, reads as follows: - "I assumed charge as C.M.M., Visakhapatnam, on 30.04.2018. There are several SARFAESI Act petitions and I have disposed several petitions. My predecessor numbered the petitions filed by the 3rd party in SARFAESI Act.
Due to pendency of two 3rd party petitions and memo with regard to name of the petitioner company are still pending. Due to pendency of the above petitions, I could not dispose of the main petition. The petitioner did not take interest to dispose of the police aid petition, break open petition and appointment of Advocate Commissioner.
I undertake to dispose of the main petition within two months, immediately after disposal of miscellaneous petitions filed by the 3rd parties, police aid petition, break open petition, appointment of Advocate Commissioner. The matter stands posted to 09.11.2018."
By placing on record the said contents, the Writ Petition stands disposed of.
