THE HON'BLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION No.6234 of 2016 ORDER:
Heard Sri N.Chandrasekhar Reddy for petitioner. On 31-01-2017, this Court called for a report from Junior Civil Judge, Pathikonda through Principal District Judge, Kurnool. The report Dis.No.1033-A/ Estt./ 2017 dated 10-02-2017 of Principal District Judge, Kurnool, is placed on record.
After perusing the accompanying letter dated 10-02-2017, this Court is compelled to observe that the trial court ought to have been prompt firstly in complying with the directions issued by this Court in C.R.P.No.5626 of 2015 and alternatively for the reasons stated in the letter dated 10-02-2017, if the trial court felt it necessary to seek extension of time from this Court, it ought to have addressed a request on the judicial side for orders in this behalf. The trial court has assumed and according to the convenience of the Court or the learned counsel appearing in the matter, I.A.No.391 of 2014 has been disposed of.
This Court is of the view that the procedure followed by the learned Judge is not consistent with the directions issued by this Court. The reason now stated in the letter for not disposing of I.A. as per direction is accepted, but the Junior Civil Judge, Pathikonda, is
instructed to be prompt in disposing of cases/ applications in which directions are issued by this Court.
Learned counsel for petitioner does not press the Civil Revision Petition.
The Civil Revision Petition is dismissed accordingly, however, with the observations noted above.
Registry is directed to communicate copy to the Principal District Judge, Kurnool, for onward transmission to the Junior Civil Judge, Pathikonda.
Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
