THE HONOURABLE SRI JUSTICE N.BALAYOGI CRIMINAL REVISON CASE No.2447 of 2018 ORDER :

Heard learned counsel for the petitioner and learned Public Prosecutor. 2.

This Criminal Revision Case is filed aggrieved by the docket order dated 12.07.2018, passed in CC No. 345 of 2018, on the file of learned Additional Munisif Magistrate, Kandukur (for the short 'the trial Court) wherein the trial Court issued Non bailable warrants against the petitioner. 3.

Since this Revision is preferred only to recall N.B.Ws issued against the petitioner, this Court deems it just and proper in the interests of Justice to dispose of the Revision itself, at the admission stage, with the consent of learned counsel for the petitioner and the learned Public Prosecutor. 4.

Having perused the same, I am of the considered view that the trial Court is competent to take cognizance and basing on the material available on record the police did not file a charge sheet for the offences under Section 354 IPC. 5.

Accordingly, with the above observations, the Criminal Revision Case is disposed of. However, It is directed that petitioner shall appear before the trial court and file recall application and, on such application being filed by the petitioner, the Trial Court is directed to consider the application, in accordance with law, and proceed with the case.

As a sequel, the miscellaneous petitions, if any pending, shall also stand closed.
